Accessibility Policy

A. Statement of Commitment

Nammex (North American Medicinal Mushroom Extracts) Inc. ("Nammex," "Real Mushrooms," "we," "us," or "our") is committed to ensuring that the website located at realmushrooms.com and the related online services (collectively, the "Website") are accessible to people of all abilities, including people with disabilities. We believe that everyone should have an equivalent opportunity to learn about, evaluate, and purchase the dietary supplement and natural health products we sell, regardless of how they access the Website.

We are committed to treating people with disabilities in a way that allows them to maintain their dignity and independence, to integrating accessibility into the way we design and operate the Website, to providing equal opportunity to access our information and services, and to communicating with people with disabilities in ways that take their disability into account.

B. Standards We Follow

We aim to conform to the Web Content Accessibility Guidelines (WCAG) 2.1, Level AA, published by the World Wide Web Consortium (W3C). WCAG 2.1 explains how to make web content more accessible to people with a wide range of disabilities, including visual, auditory, motor, speech, cognitive, learning, and neurological disabilities. WCAG 2.1 Level AA is the standard referenced by the Accessibility for Ontarians with Disabilities Act, 2005 ("AODA") and the Integrated Accessibility Standards Regulation, O. Reg. 191/11 ("IASR"), and is the standard expected of federally regulated entities under the Accessible Canada Act ("ACA") and the Accessible Canada Regulations.

In addition, we have designed the Website with consideration for: (i) the principles of the Accessible Canada Act, S.C. 2019, c. 10, including the identification, removal, and prevention of barriers to accessibility; (ii) the AODA and the IASR, including the obligation of designated organizations to make their websites and web content conform to WCAG 2.0 (and, for new websites and content published after January 1, 2014, to Level AA); (iii) the British Columbia Accessible British Columbia Act, S.B.C. 2021, c. 19, and any standards developed under it; (iv) the requirements of the Canadian Human Rights Act and the human rights legislation of the Canadian provinces and territories regarding the duty to accommodate persons with disabilities to the point of undue hardship; (v) the European Accessibility Act (Directive (EU) 2019/882), which became enforceable in EU Member States on June 28, 2025 and applies, among other things, to e-commerce services provided to consumers in the European Union, including the requirement that information be provided through more than one sensory channel, presented in an understandable way, and rendered accessible to assistive technologies, generally by reference to harmonised standard EN 301 549 (which incorporates WCAG 2.1 Level AA); and (vi) the United Kingdom Equality Act 2010, including the duty under sections 20-22 to make reasonable adjustments to avoid putting disabled persons at a substantial disadvantage in accessing services, and the related guidance from the UK Equality and Human Rights Commission.

C. What We Are Doing to Make the Website Accessible

We take the following measures to ensure the accessibility of the Website:

  • Design and development. We design new pages, templates, and features with WCAG 2.1 Level AA in mind, including providing text alternatives for non-text content, supporting keyboard navigation, ensuring sufficient colour contrast, and providing visible focus indicators.

  • Content authoring. We use heading structures, descriptive link text, alt text for product photography, captions or transcripts for video and audio content where reasonably practicable, and plain-language product descriptions where possible.

  • Forms and checkout. We label form inputs, group related fields, provide clear error messages, and support accessible payment and address-entry experiences in our checkout flow.

  • Assistive technology compatibility. We work to ensure that the Website is compatible with current and recent versions of major screen readers (including JAWS, NVDA, VoiceOver, and TalkBack), screen magnifiers, voice-recognition software, and other assistive technologies on supported browsers.

  • Third-party content. Some content on the Website is provided by third parties (including embedded videos, social media widgets, customer-review platforms, payment processors, and the personalization, A/B testing, affiliate, and marketing technologies described in our Privacy Notice). We work with our vendors to encourage accessibility and we monitor accessibility-related vendor releases, but we are not always able to control the accessibility of third-party content. Where such content is essential, we work to provide accessible alternatives or to make the underlying information available through other means upon request.

  • Training and culture. We provide training on accessibility to relevant employees and contractors, including those involved in design, content, and customer service, so that accessibility is built into our day-to-day operations.

  • Procurement. When we acquire new technology, plug-ins, or services for the Website, we consider accessibility as a factor in our selection and request information from vendors regarding the accessibility of their products.

D. Conformance Status

We continually monitor and audit the Website for conformance with WCAG 2.1 Level AA. The Website is partially conformant with WCAG 2.1 Level AA. "Partially conformant" means that some parts of the content do not yet fully conform to the accessibility standard, often because of legacy content, third-party content, or technical limitations being actively addressed. Where this is the case, we work to remediate identified issues on a reasonable timeline.

We use a combination of automated accessibility testing tools and manual review (including testing with screen readers and keyboard-only navigation) to identify issues. We also rely on feedback from users to help us identify barriers we may have missed.

E. Known Limitations

Despite our best efforts, some content on the Website may not yet be fully accessible. Known limitations include:

  • Some legacy product images and informational graphics may have limited or missing alt text. We are working to update these as part of our ongoing remediation program.

  • Some embedded video content provided by third parties may lack captions or transcripts. Where this content is essential, please contact us and we will provide an accessible alternative.

  • Certain interactive features powered by third-party plug-ins (including personalization, recommendation, A/B testing, customer-review, affiliate, and marketing widgets) may not yet fully meet WCAG 2.1 Level AA. We work with our vendors to encourage accessibility improvements.

  • Customer-submitted content (such as product reviews, photos, and questions) is not always written or formatted in an accessible way. We attempt to provide accessible context around such content but cannot guarantee that all customer-submitted content meets WCAG.

F. Feedback and Requests for Accessible Formats or Communication Supports

We welcome your feedback on the accessibility of the Website. If you encounter an accessibility barrier, have suggestions for improvement, require information from the Website in an alternative format, or would like to request a communication support to interact with us, please contact us using any of the methods below. As required under the Accessible Canada Act, the Accessible Canada Regulations, the Accessibility for Ontarians with Disabilities Act, and other applicable accessibility legislation, we will:

  • Acknowledge receipt of your feedback or request promptly, and in any case in accordance with the timelines required by applicable law (generally, an acknowledgement is provided in the same manner in which the feedback was received);

  • Consult with you to determine the most suitable accessible format or communication support;

  • Provide the accessible format or communication support in a timely manner that takes into account your accessibility needs and at no additional cost to you beyond the cost charged to other persons;

  • Take steps to remove or address the barrier, where practicable, and inform you of the outcome;

  • Treat your personal information in accordance with our Privacy Notice and applicable privacy legislation, including by allowing anonymous feedback where you prefer.

Accessible formats may include, where applicable, large print, plain-language, electronic formats compatible with screen readers, audio formats, or other formats that meet your needs. Communication supports may include, where applicable, captioning, sign language, or reading information aloud over the telephone.

I. Supported Browsers and Assistive Technologies

J. AODA Multi-Year Accessibility Plan

In addition to this Policy, where we are obligated under the Accessibility for Ontarians with Disabilities Act, we maintain a multi-year accessibility plan that outlines our strategy to identify, remove, and prevent barriers to accessibility and to meet the requirements of the Integrated Accessibility Standards Regulation. The current multi-year accessibility plan is available upon request from the Accessibility Coordinator and, where required, will be made available in an accessible format.

K. Accessible Canada Act Accessibility Plan and Progress Reports

To the extent that Nammex is a regulated entity under the Accessible Canada Act, we will: (i) prepare, publish, and update an accessibility plan in consultation with persons with disabilities; (ii) establish a process for receiving and dealing with feedback about accessibility, including feedback received anonymously; and (iii) prepare and publish progress reports describing the implementation of our accessibility plan. These documents are available upon request and will be provided in an accessible format on request, in accordance with the Accessible Canada Regulations.

L. Confidentiality of Feedback

We will keep the personal information you provide as part of your feedback confidential, in accordance with our Privacy Notice and applicable privacy law. We will not use your feedback for any purpose other than improving accessibility, responding to you, and fulfilling our legal obligations.

M. Updates to this Policy

We will review and update this Accessibility Policy from time to time as our practices evolve and as the legal and technical landscape changes. The "Last Updated" date at the top of this Policy reflects the date of the most recent update. Material changes will be communicated on the Website.

N. European Union and United Kingdom Accessibility Compliance

European Accessibility Act. To the extent the European Accessibility Act (Directive (EU) 2019/882) and its implementing legislation in the EU Member States in which we offer Products to consumers (collectively, the "EAA") apply to our e-commerce services, we work to ensure that the Website meets the applicable accessibility requirements set out in Annex I of the EAA, generally by reference to harmonised standard EN 301 549 v3.2.1 (which incorporates WCAG 2.1 Level AA). Where, after assessment, we conclude that complying with a specific accessibility requirement would impose a disproportionate burden on Nammex within the meaning of Article 14 of the EAA, we will document that assessment, periodically reassess it, and make the assessment available on request to the relevant national market surveillance authority.

UK Equality Act 2010. For users in the United Kingdom, Nammex aims to provide reasonable adjustments under sections 20-22 of the Equality Act 2010 to ensure that disabled users are not placed at a substantial disadvantage when accessing the Website or our Products. If you require a reasonable adjustment to access information about, evaluate, or purchase a Product, please contact us using the methods in Section G.

Reporting Concerns. EU and UK users who consider that the Website does not comply with applicable accessibility legislation may raise the issue with us using the methods in Section G. If you remain dissatisfied, you may also contact: (i) in the European Union, the market surveillance authority designated under the EAA in your EU Member State; or (ii) in the United Kingdom, the Equality and Human Rights Commission (https://www.equalityhumanrights.com/) or the Equality Advisory and Support Service.

O. Governing Law

This Accessibility Policy is governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of laws principles. Nothing in this Policy is intended to limit any rights you may have under the Accessible Canada Act, the Accessibility for Ontarians with Disabilities Act, the Canadian Human Rights Act, the Americans with Disabilities Act, Section 508 of the U.S. Rehabilitation Act, the European Accessibility Act and its EU Member State implementing legislation, the United Kingdom Equality Act 2010, or any other applicable accessibility, human rights, or anti-discrimination legislation.
